Ruling on Black Diamond developments will be appealed

Toward Responsible Development, a citizens group challenging Black Diamond’s approval of two planned urban villages, said it will appeal a judge’s decision rejecting the group’s complaint.

Attorney David Bricklin wrote in an email forwarded to group members Monday that King County Superior Court Judge Patrick Oishi’s ruling last month was erroneous.

Bricklin said the city didn’t adequately study traffic impacts from developer YarrowBay’s The Villages and Lawson Hills projects, and said the developments would violate city statutes by hurting city finances, locating schools too far away for students to walk, polluting Lake Sawyer and failing to generate enough new jobs.

Judge Oishi ruled that the impacts of 6,050 new homes and 1 million square feet of commercial development were adequately studied.
