PORT ORCHARD — An off-duty Drug Enforcement Administration officer who was arrested in October for being intoxicated in his truck in a Silverdale parking lot was not charged.
Claire Bradley in the Kitsap County prosecutor’s office says it was a close call, but no one saw Matthew Musselwhite drive. He told a Washington State Patrol trooper he went to his truck to sleep and started the engine to run the air conditioning.
The Kitsap Sun reported the decision Monday. Musselwhite was accused of being in physical control of a vehicle while intoxicated. He could face DEA discipline, but he won’t face a criminal charge.
