Grant County deputy cleared of shooting dog

The Associated Press

SPOKANE — A federal jury in Spokane has cleared a Grant County sheriff’s deputy who shot and killed a dog that attacked his own police dog at a Moses Lake park.

The owner, Nicholas Criscuolo, had sued the county and Deputy Beau Lamens, claiming that the 2010 killing of his dog deprived him of his constitutional property rights.

The Spokesman-Review reports that a jury in U.S. District Court in Spokane last week ruled against Criscuolo, though they did award a judgment of more than $3,800.

That money was given to cover the costs of a burial and the “intrinsic value” of the dog.

The Chelan County Sheriff’s Office handled a criminal investigation of the matter, concluding no charges were warranted against Lamens. Criscuolo then filed a civil lawsuit.
